Copyright & DMCA Policy

1. Reporting infringement (takedown notice)

To report material you believe infringes your copyright, send a written notice to our designated agent (below) that includes all of the following:

• Your physical or electronic signature (typing your full legal name is sufficient).
• Identification of the copyrighted work you claim has been infringed.
• Identification of the material you claim is infringing, with enough detail for us to locate it — including the ClaspMarket URL(s) (e.g. the listing or profile link).
• Your name, mailing address, telephone number, and email address.
• A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
• A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner's behalf.

When we receive a valid notice, we will remove or disable access to the material and make a good-faith effort to notify the seller who posted it.

2. Where to send notices (designated agent)

Send copyright notices and counter-notices to our designated agent:

3. Counter-notification

If your content was removed and you believe it was removed by mistake or misidentification, you may send our agent a counter-notice that includes:

• Your physical or electronic signature.
• Identification of the material that was removed and the location where it appeared before removal.
• A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
• Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for your district (or, if outside the U.S., any district in which ClaspMarket may be found) and that you will accept service of process from the party who filed the original notice.

If we receive a valid counter-notice, we may restore the material in 10–14 business days unless the original complainant notifies us that they have filed a court action to keep it down.

4. Repeat infringers

We will, in appropriate circumstances, disable or terminate the accounts of users who are repeat infringers. We may also remove content and suspend accounts at our discretion to protect the service and its users.

5. Misrepresentations

Under the DMCA, knowingly making a material misrepresentation in a notice or counter-notice — for example, claiming infringement that does not exist — can expose you to liability for damages. Please make sure your claim is valid before submitting it.

6. Seller responsibility

By listing on ClaspMarket you represent that you own, or are licensed to sell, everything you list, and you agree to indemnify ClaspMarket against claims arising from your content, as described in our Terms of Service. Listings that infringe intellectual property are prohibited and may be removed.
